BusinessUS Trade Court Rules Trump 10 Percent Global Tariffs Are Illegal
The US Court of International Trade ruled 2 to 1 on May 7 that the Trump administration lacks legal basis for its 10 percent global tariffs.
The US Court of International Trade issued a ruling on May 7th regarding the 10% global import tariffs imposed by the Trump administration, determining that the tariffs lack legal basis.
Previously, the US Supreme Court had ruled in February of this year that the double-digit tariffs initially levied by Trump exceeded the scope of his executive authority.
Subsequently, Trump invoked another law to reintroduce a 10% import tariff. However, the law only permits tariffs when the balance of payments is severely imbalanced.
The court found that the United States currently does not exhibit such an imbalanced condition and therefore the tariff lacks legitimacy.
The ruling was a 2-to-1 majority decision, with one judge considering a preliminary ruling in favor of small business plaintiffs to be premature.
Currently, the tariff remains effective for other importers and is expected to expire in July.
The Trump administration indicated it will appeal this ruling.
